Журналист Катерина Борисевич остается под стражей в СИЗО КГБ

Сегодня истек 72-часовой срок задержания журналиста Катерины Борисевич. Она не вышла на свободу и остается в СИЗО КГБ до предъявления обвинения — как минимум до 29 ноября. Катерина проходит подозреваемой по ч. 3 ст. 178 УК — разглашение врачебной тайны, приведшее к тяжким последствиям. Уголовное дело возбудила Генеральная прокуратура.

Вечером 19 ноября наша коллега Катерина Борисевич была задержана сотрудниками в штатском и масках, которые после обыска в квартире увезли ее в неизвестном направлении. Чуть позже Катерина сообщила дочери и коллегам, что она в СИЗО КГБ, 20 ноября состоялся первый допрос. Как известно из сообщений Генпрокуратуры, возбуждено уголовное дело по факту разглашения врачебной тайны. Речь идет о состоянии погибшего Романа Бондаренко, Катерина была автором статьи, где указывалось, что в его крови не было алкоголя. С адвоката журналиста Михаила Боднарчука взяли подписку о неразглашении, поэтому подробностей уголовного дела мы не знаем.

Генеральная прокуратура возбудила уголовное дело в отношении врача больницы скорой медицинской помощи и иного лица по ч. 3 ст. 178 УК (Разглашение врачебной тайны, повлекшее тяжкие последствия).

— Действуя умышленно, без служебной необходимости, подозреваемый вступил в преступный сговор с представителем интернет-ресурса (), которому сообщил сведения о результатах медицинского освидетельствования Романа Бондаренко. Тем самым он разгласил врачебную тайну, при этом представил недостоверную информацию, — заявили в Генпрокуратуре. — Деяния названных лиц повлекли за собой тяжкие последствия, выразившиеся в повышении напряженности в обществе, создании атмосферы недоверия к компетентным государственным органам, побуждении граждан к агрессии и противоправным действиям.

Генеральная прокуратура вправе как направить дело для расследования в следственные органы (Следственный комитет или Комитет государственной безопасности), так и самостоятельно проводить предварительное следствие — «в целях обеспечения всестороннего, полного и объективного исследования обстоятельств уголовного дела» (ст. 34 УПК).

Разглашение врачебной тайны, повлекшее тяжкие последствия, наказывается лишением свободы на срок до трех лет со штрафом и с лишением права занимать определенные должности или заниматься определенной деятельностью или без лишения. Вообще, по факту разглашения врачебной тайны дело возбуждается по заявлению потерпевшего, поскольку это является делом частного обвинения (ч. 1 ст. 178 УК). Но если речь о наступлении тяжких последствий (ч. 3 ст. 178 УК), а именно такой формулировкой оперирует Генпрокуратура, то в этом случае это уже дело публичного обвинения, и правоохранительные органы, в том числе прокуратура, могут возбудить дело и без заявления потерпевшего, как и произошло в данном случае.

В комментарии к Уголовному кодексу отмечается, что «под тяжкими последствиями понимаются, например, такие последствия, которые привели к увольнению лица с занимаемой должности, к разводу, самоубийству, заболеванию психической болезнью и т.п.». Как видим, перечисленные последствия имеют непосредственное отношение к лицу, о диагнозе которого узнала общественность. Что же о «тяжких последствиях» сообщает Генеральная прокуратура? «Деяния названных лиц (врача и сотрудника . — Прим. ред.) повлекли за собой тяжкие последствия, выразившиеся в повышении напряженности в обществе, создании атмосферы недоверия к компетентным государственным органам, побуждении граждан к агрессии и противоправным действиям». При этом уголовным законом ст. 178 УК отнесена к преступлениям «против уклада семейных отношений и интересов несовершеннолетних».

Катерина более 10 лет работает журналистом, отмечена профессиональными наградами, специализируется на освещении правовых тем, она писала о многих резонансных уголовных делах. Белорусская ассоциация журналистов требует немедленно освободить Катерину Борисевич.

Обращаясь в первую очередь к Генеральной прокуратуре, БАЖ призывает сосредоточиться на поиске виновных в смерти Романа Бондаренко (дело расследует Генпрокуратура), а не преследовать журналиста, которая подготовила материал, и врача, который дал комментарий по социально важной теме, не нарушив права родственников погибшего.

Напомним, родственники Романа претензий СМИ и медперсоналу не высказывали, мать дала согласие на распространение информации о состоянии сына.

Michael Owen has claimed Liverpool's in-form forward Diogo Jota is 'the signing of the season' after his blistering start to the campaign.

Liverpool signed the Portugal international from Wolves for £41million in the summer and he has been in fine form so far, with nine goals in his first 15 games.

But former Anfield hero Owen said few expected Jota to be as impressive as he has been in the opening stages of the season.

'No one could've predicted that he would hit the ground running like he has,' the ex-Liverpool and England striker said on BT Sport.

'You’d have to say he’s the best signing of the season so far in the Premier League.

'He’s surprised me with his pace, I must admit. I think he’s far quicker than I gave him credit for. Against Atalanta he was electric.

'He just shows composure. A lot of people panic, they just get a shot off as soon as they get any form of space.

'I just think he’s scored headers, right foot, left foot, he’s scored everything so far and he’s looked the real deal in terms of linking play.

'Nobody could have envisaged the quality that he’s shown so far.'

Jota, 23, appeared to be a high-end substitute for Liverpool's feared frontline of Mohamed Salah, Roberto Firmino and Sadio Mane when he signed in the summer.

But he has proven himself to be far more influential for Jurgen Klopp's side in what is a particularly gruelling season, with competitions compressed due to the pandemic.

The Portugal international showed his worth again in the 1-1 draw with Brighton on Saturday, netting the opening goal with a low shot after a clever dummy.

The match ended with VAR controversy when Pascal Gross converted a dubious penalty given for Andy Robertson's challenge on Danny Welbeck, but it was another excellent showing from Jota.

He was similarly lively against Ajax in the Champions League on Tuesday night as he kept his starting spot, with Liverpool demonstrating their steel in a 1-0 win.

It seems Jota will be key to Klopp's men competing on all fronts, and Sportsmail columnist Peter Crouch admitted he had been just as surprised by the Portuguese on BT Sport.

'You couldn’t have envisaged it because of his goal record at Wolves,' he said.

'Klopp’s obviously seen something in him, putting him more central or along the three of the strikers that they have.

'He looks like a poacher. He’s getting goals in the six-yard box, he’s got headers, he’s got all types of goals. He’s a top, top signing.'

The Weeknd has doubled down on claims the Grammys are 'corrupt' after failing to nab a single nomination for this year's awards.

The Canadian talent, 30, alluded to the controversy once again on Instagram Wednesday, calling out the Recording Academy amid reports the snub was in retaliation for his choice to perform at the Super Bowl instead of the awards.

'Collaboratively planning a performance for weeks to not being invited?' he wrote in white text on a black background. 'In my opinion zero nominations = you're not invited.'

The Weeknd earned the support of Elton John, 73, who took to Instagram on Wednesday to denounce the slight.

The Benny And The Jets legend shared the cover of Blinding Lights and wrote: 'In my humble opinion............. Blind Lights. Song of the Year. Record of the Year.' Making his point clear, he added the tag '#GrammySnub.'

Elton and The Weeknd became friends after the younger artist riffed on the classic Your Song on his track Scared To Live.

'I'm so blown away I mean just to be part of his record,' Elton told Billboard earlier this year. 'For someone my age and as someone who loves what he does, I'm so thrilled and I just love him.'

The Starboy singer's Wednesday post appeared to confirm reports he had been in talks with the Recording Academy about a potential performance.

He didn't hold back in his criticism after Tuesday's nominations were announced, calling the show 'corrupt.'

'You owe me, my fans and the industry transparency...' he went on.

The Toronto-based star was involved in talks over whether he could play at the upcoming Super Bowl, sources told TMZ Tuesday.

Grammy organizers had demanded he pass on taking the stage at Super Bowl LV, before relenting and deciding he could do both.

Insiders said that the Can't Feel My Face artist's camp suspected the lack of nominations were in response to the unpleasant back and forth over whether he would perform in the Super Bowl.

Recording Academy interim chief Harvey Mason, jr. responded to the singer's public complaints in a statement to Rolling Stone.

'We understand that the Weeknd is disappointed at not being nominated,' he said. 'I was surprised and can empathize with what he's feeling. His music this year was excellent, and his contributions to the music community and broader world are worthy of everyone's admiration.'

Mason continued: 'We would have loved to have him also perform on the Grammy stage the weekend before' the Super Bowl. Unfortunately, every year, there are fewer nominations than the number of deserving artists.

'To be clear, voting in all categories ended well before The Weeknd's performance at the Super Bowl was announced, so in no way could it have affected the nomination process. All Grammy nominees are recognized by the voting body for their excellence, and we congratulate them all.'

Asked by Variety about The Weeknd getting shut out, Mason said Tuesday, 'It really just comes down to the voting body that decides.

'We have eight nomination slots to fill in [the Big Four categories: Best Album, Song, Record and New Artist], five in others, and the voters vote for their favorites. It's really interesting, though.'

Mason opened up about the process Grammy officials take to suss out which performers are nominated, and in what categories.

'We look at it every year and make tweaks and revisions to the process; we did it this year, last year, we'll do it next year. And I don't think this calls it into question, honestly,' Mason said. 'The process is there so we can continue to monitor excellence.'

Mason said he's overseen the process and 'the people that were in it are music professionals - they are excellent, at the top of their craft in songwriting and producing, and there are a lot of artists.'

He continued: 'They were critically listening to every song that came across their desks - or virtual desks - so I don't think it shows a flaw in the process.

'I think it's actually… as you get a nomination, you start to really appreciate the process, where you're saying, 'I really made it through a strenuous and thoughtful process,' to get to who are really the deserving nominees for that given year.'

The Weeknd previously took home the Best Urban Contemporary Album for Starboy in 2018.

Wayne Pivac is determined to propel Wales back to the future knowing his green team face a stern early examination by England.

The New Zealander picked a team full of untested combinations, mixed with experienced men, especially in the back-row where James Botham and Shane Lewis-Hughes start in a new back-row combination with Taulupe Faletau.

Pivac believes rookie Cardiff Blues pair, described as the ‘last men standing’ as Justin Tipuric and Josh Navidi still have concussion symptoms, can perform against Tom Curry and Sam Underhill.

‘It we felt they weren't ready, we wouldn't have put them out there,’ he said.

‘What a match for these guys to be tested in.’

Louis Rees-Zammit, Josh Adams and Leigh Halfpenny, in for Liam Williams, who has a cut lip, have never played together either.

And centres Johnny Williams and Nick Tompkins started the match for the first time together last week.

So while an England game boils the blood like no other in Wales, Pivac is sticking to his development plan for the 2023 World Cup despite six defeats in eight.

‘It's not a Six Nations or World Cup match,’ he added.

‘But is a Test match and it is England against Wales. We'll be going out there to do the best we can to win the match, obviously, but along the way we will learn a lot as well.

‘We’re not looking at people for a one-off game. We’re looking at the future here, 2023.

‘We'll certainly be looking for a lot of heart. The Six Nations won't be about opportunities.’
